Our website address is: https://daphnemalta.com. Daphne Malta is operated by an independent distributor of Daphne JSC. While Daphne JSC is a company registered in Bulgaria (ul. Perperikon 9, Varna), this website is managed and operated independently for the Maltese market.

2. Your Status

By placing an order on our site, you confirm that:

  • You are legally capable of entering into a binding contract with us.

  • You are an authorised user of the payment method used for the order.

3. How the Contract is Formed

When you place an order on our site, you will receive an email acknowledging receipt of your order. Please note that this email does not confirm acceptance of your order. All orders are subject to availability and acceptance by us.

A contract between you and us is formed when we confirm that your order has been dispatched. Until then, we reserve the right to cancel your order for any reason.


4. Delivery

We aim to deliver your order by the estimated delivery date set out in your dispatch confirmation. However, delivery times may vary depending on the delivery service selected.

Key Delivery Terms:

  • Delivery will be complete when the Products are delivered to the address provided.
  • If no one is available to receive the delivery, our carrier may attempt redelivery or leave the package in a safe place.
  • You will own the Products once we have received full payment.
  • We are not liable for delays caused by events outside our control.

If you do not receive your order within the expected timeframe, please contact us at info@daphnemalta.com. Claims for missing deliveries must be made within 28 days from the date of dispatch.


5. Prices and Payment

All prices on our site are displayed in Euros (€) and include VAT at the applicable rate. Delivery charges are calculated and displayed during the checkout process.

We reserve the right to change prices at any time. However, any changes will not affect orders that have already been accepted.

We accept payment via the following methods:

  • Maestro

Payment must be made at the time of order placement. We will not process your order until payment has been received in full.


6. Returns and Refunds

We want you to be completely satisfied with your purchase. If you are not happy with your item, you may return it within 14 days of receipt for a refund or exchange, provided the item is in its original condition and packaging.

How to Make a Return:

  1. Contact us at info@daphnemalta.com to initiate a return or use the Return Request form from your account page.
  2. Ensure the Products are securely packaged.
  3. Use our provided return instructions, which you’ll receive by email, to send the Products back to us.

We will process refunds within 14 days of receiving the returned Products. Refunds will be issued to the original payment method.

Please note:

  • Items marked as final sale cannot be returned.
  • If a returned item shows signs of wear or damage, we reserve the right to reduce the refund amount or to decline your request.

7. Faulty Products

If you believe your Product is faulty or defective, please contact us immediately at info@daphnemalta.com. You may be required to provide photographic evidence of the issue.

If the Product is found to be faulty, we will offer a replacement or a refund, including any delivery charges incurred.


8. Cancellation Policy (EEA Customers Only)

If you are a consumer in the European Economic Area (EEA), you have the right to cancel your order within 14 days of receiving your Products.

To cancel your order:

  2. Return the Products to us within 14 days of notifying us of your cancellation.

We will refund the full amount paid, within 14 days of receiving the returned Products.


9. Our Liability

We are responsible for any foreseeable loss or damage you suffer as a result of our breach of these terms. However, we are not responsible for any loss or damage that is not foreseeable or for any business losses.

Nothing in these terms limits our liability for death or personal injury caused by our negligence or fraudulent misrepresentation.


10. Events Outside Our Control

We will not be liable for any delay or failure to perform our obligations under the Contract due to events beyond our reasonable control, such as natural disasters, strikes, or government restrictions.


11. Intellectual Property Rights

All content, images, and materials on our site are the property of Daphne Malta or our licensors. You may not use any part of our site’s content for commercial purposes without obtaining a licence from us.


12. Changes to Terms and Conditions
